Texas Inheritance Laws

Representation from a Houston Estate Planning Lawyer

When an individual passes away without having a valid will in place, the property of the deceased is distributed through the terms of the inheritance laws in Texas. The inheritance laws are also known as the intestate succession rules in which the property is distributed to the decedent's closest living relatives. If your loved one has passed away without having a valid will in place, Shepherd & Associates can help. Our Houston estate planning lawyer can explain the terms of the intestate laws and make sure that you get the property that you are entitled to.

Intestate Succession Laws in Texas

The court abides by the intestate succession laws in Texas when a will of the decedent does not exist. Depending on whether a spouse, children, siblings, or parents are involved can alter the terms of the inheritance laws. If only one of the four mentioned individuals are involved, they would inherit everything. An example of this occurrence would be if the decedent only has parents, then the parents would get the entire estate.

If none of the mentioned individuals exist, the estate would be distributed to people who are less related to the decedent; this includes aunts and uncles, nieces and nephews, great aunts and great uncles, and so forth. If a person does not have any living relatives or relatives even remotely related to them, the property would then be provided to the state of Texas.
